Terms of Service

Effective date: July 14, 2026

These Terms of Service ("Terms") govern your use of www.spurauto.com and any free review, appraisal report, document-support package, priority-delivery option, or related service provided by Spur Auto. By using the website or purchasing a service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or purchase a service.

1. Eligibility and authority

You must be at least 18 years old and legally able to enter into a contract. By submitting claim or vehicle information, you represent that you are authorized to provide it and to request the service.

2. Services

Spur Auto provides independent vehicle valuation services. Available offerings may include a free preliminary claim review, Essential, Guided, Specialty, Specialty plus Guided, Priority Delivery, and business partner programs. Current package descriptions, prices, and included deliverables appear on the Pricing page and at checkout.

A free claim review is a preliminary assessment based on limited information. It is not an appraisal, coverage opinion, promise of a higher settlement, or commitment to accept an engagement.

3. Independent appraisal and document-support boundaries

Our appraisal reports express an independent opinion of vehicle value based on the records, photographs, market information, and other materials reasonably available when the report is prepared. We do not control an insurer's coverage decision, valuation method, response, payment, or settlement.

Guided Document Support may include claim-specific draft correspondence, an evidence index, a key-findings summary, a report walkthrough, review and explanation of written insurer responses, negotiation guidance, and assistance drafting follow-up correspondence throughout negotiations. You remain solely responsible for every claim decision, including what information to submit and whether to accept, reject, or dispute an offer. You review, approve, and send every communication.

Spur Auto provides negotiation support and guidance but does not contact or negotiate with an insurer on your behalf, represent you in a claim, adjust or settle your claim, make coverage decisions, act as your attorney or public insurance adjuster, or create an attorney-client, fiduciary, or representative relationship.

4. Your responsibilities

You agree to provide complete, accurate, and lawful information; promptly provide requested documents; disclose known facts that could materially affect value; review drafts and reports for factual errors; protect any download links or account information; and use deliverables only for lawful purposes related to the vehicle or claim for which they were prepared.

You are responsible for reading your policy, tracking all contractual and legal deadlines, preserving evidence, and obtaining advice from a qualified attorney, tax professional, or licensed insurance professional when appropriate. We are not responsible for a missed deadline or adverse decision caused by incomplete, inaccurate, or delayed information.

5. Fees and payment

Fees are displayed before purchase and are charged as one-time amounts unless clearly stated otherwise. Payments are processed by Stripe and may be subject to Stripe's terms. You authorize the charge shown at checkout and agree to provide accurate billing information.

If a payment is reversed, disputed, declined, or suspected of fraud, we may pause or cancel work until the matter is resolved. You remain responsible for amounts properly due for services requested and delivered.

6. Delivery

Standard delivery is targeted within 48 hours after we receive all documents and information reasonably required to begin. A 24-Hour Priority Delivery option may be available for an additional fee. Delivery periods begin only when the file is complete and may be affected by your response time, unusual vehicle research, third-party data availability, force majeure, or circumstances disclosed before acceptance.

If we miss an accepted Priority Delivery deadline, the Priority Delivery fee will be refunded and the report will move to the standard delivery timeline. Delivery estimates do not guarantee that an insurer will review or respond within any particular time.

7. Money-back guarantee and refunds

If the completed independent appraisal does not support a vehicle value higher than the insurer's offer supplied to us for review, we will refund the paid report-package fee. The guarantee compares the appraisal's concluded value with the insurer offer provided before the appraisal was completed. It does not guarantee that the insurer will change its offer or pay the appraised amount.

Priority Delivery fees are governed by Section 6. Except where required by law or expressly stated in these Terms, fees are otherwise nonrefundable once substantive work has begun. To request an eligible refund, contact us with the name and email used for the purchase.

8. Revisions and addenda

We will correct verified factual or clerical errors reported within a reasonable time after delivery. Guided packages include one factual addendum requested within 14 days after report delivery. New facts, changed assumptions, additional vehicles, later market data, or expanded assignments may require a separate engagement and fee.

9. Intellectual property and permitted use

The website, branding, templates, report formats, methodologies, graphics, and general materials are owned by Spur Auto or its licensors and are protected by applicable law. After full payment, you receive a limited, nonexclusive, nontransferable license to use your final report and claim-specific deliverables for your own vehicle claim and related professional consultation. You may provide them to your insurer, attorney, lender, repair facility, or other person involved in that matter.

You may not resell, publish, alter, misrepresent, remove attribution from, or use a report for another vehicle or claim without written permission.

10. No warranties

Except for the express refund and delivery commitments stated in these Terms, the website and services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the website will be uninterrupted or error-free, that any particular comparable will remain available, or that any insurer, appraiser, umpire, court, or other party will accept our conclusions.

11. Limitation of liability

To the fullest extent permitted by law, Spur Auto will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost use, loss of data, or an insurer's acts or omissions arising from or related to the website or services. Our aggregate liability for any claim arising from a purchased service will not exceed the amount you paid Spur Auto for that service. These limitations do not apply where applicable law does not permit them.

12. Indemnification

You agree to indemnify and hold Spur Auto harmless from third-party claims, losses, and reasonable costs arising from information you provide, your unlawful or unauthorized use of a deliverable, or your material violation of these Terms, except to the extent caused by our own unlawful conduct.

13. Governing law and disputes

These Terms are governed by Texas law, without regard to conflict-of-law principles. Before filing a lawsuit, each party agrees to provide written notice of the dispute and allow 30 days for a good-faith effort to resolve it. Any court proceeding must be brought in a court of competent jurisdiction in the Texas county where Spur Auto maintains its principal place of business, unless applicable law requires otherwise.

14. Changes and general terms

We may update these Terms prospectively by posting a revised version with a new effective date. Terms in effect when you purchase a service will govern that purchase unless you agree otherwise. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business reorganization or transfer.

Spur Auto is an independent vehicle appraisal firm. We are not a public insurance adjuster. We provide negotiation support such as reviewing insurer responses, explaining valuation issues, and helping draft follow-up correspondence, but we do not contact or negotiate with the insurer on your behalf, settle claims, or act as your representative - every decision and communication about your claim remains yours. We are not a law firm, we do not provide legal advice, and we are not affiliated with or endorsed by any insurance company.
